The agreement between you and CircleRoll LLC for the use of FaxProof.
FaxProof transmits documents over the public switched telephone network on your behalf, and receives faxes on numbers we provision for you. It is operated by CircleRoll LLC. Transmission uses our carrier, Telnyx. A signed delivery receipt is generated from the carrier's delivered event. It is evidence of transmission to the destination number, not legal proof that a particular person read the page.
PDF and images are prepared on your device. Office files on Free, Page pack, and Premium may be converted on our servers via CloudConvert. Business (BAA) Office files are converted only with self-hosted LibreOffice. If that converter is unavailable we reject the file and ask you to export a PDF. We never send Business documents to CloudConvert.
Pages are reserved when you press send and deducted only when the receiving machine confirms receipt. If a transmission fails for any reason, the pages return to your balance automatically and we retry up to three times at no cost. After a third failure the pages are refunded in full.
Page packs do not expire. Subscription page allowances reset each period and do not roll over.
Phone verification unlocks a one-time five-page allowance; it is not a recurring free tier.
Subscriptions renew until cancelled. We notify you 48 hours before each renewal with the exact amount. Canceling stops future renewals and your plan remains active through the end of the period you already paid for — access is never cut short.
Free trials run for the length stated on the paywall at the moment you start. Cancel any time before the end of the trial and you are not charged.
Purchases made through the App Store or Google Play are billed and cancelled by Apple or Google under their terms. We cannot cancel or refund those on your behalf.
You must be at least 18 and able to form a contract. You are responsible for the content you transmit and for having the right to transmit it. You agree not to use FaxProof to send unsolicited advertising faxes in violation of the Telephone Consumer Protection Act or equivalent law, to harass any recipient, or for anything unlawful.
Every page you send carries a header showing the date, time, your name and your fax number, as US law requires. This cannot be disabled.
Numbers are licensed to you for the duration of your subscription, not sold. If your subscription lapses the number may be released after a grace period and cannot be guaranteed afterwards. Numbers in certain countries require regulatory documentation before activation; you are not charged until a number is active. We do not silently substitute a different number.
We may suspend an account that generates sustained delivery failures, abuse complaints or carrier blocking, or that violates these terms. Where possible we'll contact you first.
We aim for continuous availability but do not guarantee it. Fax transmission depends on carrier networks and on the receiving equipment, neither of which we control. Where a failure is on our side, affected pages are refunded automatically. THE SERVICE IS PROVIDED “AS IS”. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
If you transmit protected health information you must have a Business Associate Agreement in place with us first. Request one in Settings. Without a signed BAA, do not use FaxProof for PHI.
To the extent permitted by law, our aggregate liability is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including any consequence of a fax that fails to arrive. This limit does not apply to death, personal injury, or liability that cannot be limited under applicable law.
You may stop using FaxProof and delete your account at any time. Unused pages are forfeited on deletion. Deleting your account does not cancel an App Store or Google Play subscription. Carrier numbers are released on deletion.
We may update these terms and will notify you in the app of material changes before they take effect.
These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules. CircleRoll LLC · hello@faxproof.com
